                                   Anthony P. Capretta

                                                                                       Medina County Auditor

Anthony Capretta was selected by the voters of Medina County to serve as Auditor on November 8, 2022. Public service to the community is not new to Anthony. He served on Brunswick City Council for 17 years representing Ward 4. As councilman representing Ward 4, he was an active problem solver for his constituents. Anthony served in many roles as a city councilman. He chaired the Safety, Building Code, and Services & Technology committees during his tenure. He also lent his expertise to the Economic Development, Parks & Recreation, and Finance Committee as a standing member.

Anthony’s career has uniquely qualified him to represent Medina County as Auditor. He has over 30 years experience serving the public in Law Enforcement and Judicial Administrative functions of government. Anthony graduated with an associate of science degree in Law Enforcement at Cuyahoga Community College and went on to Case Western Reserve University Gund School of Law - Ohio Peace Officer Training Academy. He became a police officer for 7 years. Anthony used his law enforcement training becoming a bailiff serving both Common Pleas and Juvenile Courts.

Capretta later turned his career in a new direction serving as an employee of the largest Auditor's Office in Ohio. Anthony’s dedication to public service and being a good steward was recognized and put to good use. During his tenure with the Auditor’s office Anthony thrived in several roles. Anthony worked in the Appraisal, Community Outreach, and Weights & Measures departments. Auditor Capretta worked and trained his whole life to fulfill the role of Auditor for Medina County. His plans are to utilize technology and innovative processes to make the office more effective and efficient in its operation better serving Medina County.

BOR
Board of Revision (BOR)

The Board of Revision's primary function is to determine the true market value (estimated selling price) of a property. Please keep in mind, it does not deal with taxes or tax rates for your property or the appraised value of your neighbor's property. The board will take into consideration any unique aspects of your property. Be advised that by Ohio law, the burden of proof to establish market value is on the property owner.

We are accepting BOR forms until March 31st, 2025.

CAUV
CAUV

Current Agricultural Use Value (CAUV) is a program to reduce the taxable value of land being used for commercial agricultural production. By permitting values to be set well below true market values, CAUV normally results in a substantially lower tax bill for working farmers.

Qualification Requirements

Land must meet one of the following requirements during the three years preceding an application for CAUV:

  • Ten or more acres must be devoted exclusively to commercial agricultural use
  • If under 10 acres are devoted to commercial agricultural use, the farm must produce an average yearly gross income of at least $2,500

Initial Application

To sign up, there is a one-time fee of $25 for initial applications. Initial Application for Valuation of Land at Its Current Agricultural Use must be submitted between the first Monday in January and the first Monday in March.

Renewal Application

Renewal Application for Current Agricultural Use Value

Applications must be renewed annually, but there is no annual renewal fee. The deadline for renewal applications is the first Monday in March.

If you do not renew your application, the Medina County Auditor's Office is required to value the property at its true or current market value and to recoup the taxes for the past three years.

Land that is removed from the CAUV program is charged a recoupment.

What qualifies for CAUV?

How does CAUV valuation differ from current market value?

The value of the land that is being farmed is reduced based on the type of soil in the property. There is no reduction on the home site area or any buildings. The true market value approach depends upon the comparison of sales of similarly situated farms and where the highest and best use sets value. The CAUV method depends upon capitalizing the expected net income from farming. Because market value reflects what a buyer is willing to pay, regardless of the farms agricultural production capability, some farms may have lower appraised values through the CAUV program.


How is CAUV calculated?

Each year, the Ohio Department of Taxation sets Current Agricultural Use Values for each of Ohio's soil types. To view current values and explanations of how the values were established, visit the Ohio Department of Taxation.


Are there any penalties for removal of property from program?

Yes. If at any time the land, or a portion of the land, does not meet the requirements to remain in the program a recoupment will be placed on the tax bill. If only a portion of the land is converted, the remainder will remain on the program as long as it continues to meet the qualifications. The land is allowed to lie fallow for one year and automatically remain in the program, the second and third year remain in program if good cause is proven to the Board of Revision.


What is a recoupment?

The recoupment charge is three years worth of savings that accumulated prior to conversion in the CAUV program, versus valuation outside of the program.


Who is responsible for paying the recoupment?

The recoupment will appear on the tax bill of the owner after the property changes use and/or hands. The total amount is recouped in one year by equally dividing the total between the first- and second-half tax bill. If a transfer of ownership causes the conversion, the seller and buyer decide who pays the recoupment. However, if the recoupment is not paid when the land is converted, the recoupment will go on the new owner's tax bill.


When do I file?

After the first Monday in January and before the first Monday in March of the year for which the agricultural use value is sought.

Conveyance Form

For the transfer of legal title of real property from one person to another, subject to a conveyance fee based on the value of real estate sold or transferred. The real property conveyance fee for Medina County is $3.00 per $1,000 of the sale price. (For a sale ending in a fraction of $100, the sale price is rounded up to the nearest $100.)




Exempt Conveyance Form

For the transfer of legal title of real property from one person to another, exempt from a conveyance fee for any of the following reasons:

  1. To or from the United States, this state or any instrumentality, agency or political subdivision of the United States or this state.
  2. Solely in order to provide or release security for a debt or obligation.
  3. To confirm or correct a deed previously executed and recorded.
  4. To evidence a gift, in any form, between husband and wife, or parent and child, or the spouse of either.
  5. On sale for delinquent taxes or assessments.
  6. Pursuant to court order, to the extent that such transfer is not the result of a sale effected or completed pursuant to such order.
  7. Pursuant to a reorganization of corporations or unincorporated associations or pursuant to the dissolution of a corporation, to the extent that the corporation conveys the property to a stockholder as a distribution in kind of the corporation’s assets in exchange for the stockholder’s shares in the dissolved corporation.
  8. By a subsidiary corporation to its parent corporation for no consideration, nominal consideration or in sole consideration of the cancellation or surrender of the subsidiary’s stock.
  9. By lease, whether or not it extends to mineral or mineral rights, unless the lease is for a term of years renewable forever.
  10. When the value of the real property or interest in real property conveyed does not exceed $100.
  11. Of an occupied residential property being transferred to the builder of a new residence when the former residence is traded as part of the consideration for the new residence.
  12. To a grantee other than a dealer in real property, solely for the purpose of and as a step in, its prompt sale to others.
  13. To or from a person when no money or other valuable and tangible consideration readily convertible into money is paid or to be paid for the real estate and the transaction is not a gift.
  14. To an heir or devisee, between spouses or to a surviving spouse, from a person to himself and others, to a surviving tenant, or on the death of a registered owner.
  15. To a trustee acting on behalf of minor children of the deceased.
  16. Of an easement or right-of-way when the value of the interest conveyed does not exceed $1,000.
  17. Of property sold to a surviving spouse pursuant to Ohio Revised Code section (O.R.C.) 2106.16.
  18. To or from an organization exempt from federal income under Internal Revenue Code section 501(c)(3), provided such transfer is without consideration and is in furtherance of the charitable or public purpose of such organization.
  19. Among the heirs at law or devisees, including a surviving spouse of a common decedent, when no consideration in money is paid or to be paid for the real property.
  20. To a trustee of a trust, when the grantor of the trust has reserved an unlimited power to revoke the trust.
  21. To the grantor of a trust by a trustee of the trust, when the transfer is made to the grantor pursuant to the exercise of the grantor’s power to revoke the trust or to withdraw trust assets.
  22. To the beneficiaries of a trust if the fee was paid on the transfer from the grantor of the trust to the trustee or pursuant to trust provisions that became irrevocable at the death of the grantor.
  23. To a corporation for incorporation into a sports facility constructed pursuant to O.R.C. section 307.696[307.69.6].
  24. Between persons pursuant to O.R.C. section 5302.18.
  25. From a county land reutilization corporation organized under O.R.C. section 1724 to a third party.



Manufactured or Mobile Home Conveyance Form

For the transfer of legal title of a manufactured home from one person to another, subject to a conveyance fee based on the value of the manufactured home sold or transferred. The manufactured home conveyance fee for Medina County is $1.00 per $1,000 of the sale price. (For a sale ending in a fraction of $100, the sale price is rounded up to the nearest $100.)

A written document transferring ownership of land, and the buildings thereon, to another person or persons in which the owner passes on all the rights he possesses on his property to the purchaser.


Survivorship Deed (.pdf)

This type of deed defines the interest obtained by the grantees who become owners of real property and, upon the death of any such person, places the interest of the decedent in the survivor.


The Medina County Recorder's Office requires document margins to be:

    -  First Page - 3" from top, 1" from all other sides

    -  Additional Pages - 1.5" from top, 1" from all other sides

    Recording fees are the same for both 8.5" x 11" and 8.5" x 14" documents.

    Transferring/Conveying Property

    Three easy steps, and everything can be completed in the County Administration Building:

    144 N. Broadway Street in Medina.

      NOTE: County offices are not able to create deeds, affidavits, or other documents. If you need
      assistance, a licensed attorney or title agency are your best options. The Auditor and Recorder only
      accept documents with original notarized signatures.


    STEP 1  - Tax Maps - Room 116
    Checks the “legal description” that must be included with a conveyance.
    Please allow for a minimum of 30 minutes; more at peak times.


    Step 2  -  Auditor's Office - Room 301
    Transfers the ownership for tax records.
    Collects a conveyance fee, unless the conveyance is eligible for an exemption. Either way; all conveyances require either the:

    DTE 100EX Statement of Reason for Exemption From Real Property Conveyance Fee.
    Please allow 15-20 minutes, although at peak times it could take longer.

    “Records” the document, making it a “public record.” This is a critical step in protecting ownership rights.

    Dog License
    Dog License


    All dogs 3 months of age or older must be licensed, regardless of whether the dog is kept inside or out. In addition to the law, licensing your dog is their ticket home when they are lost.

    Please remember that dog licenses are to be renewed between December 1st and January 31st of each year. During this renewal period, licenses will cost $14.00 per dog. If you do not purchase your license during the renewal period, an additional late penalty of $14.00 will be added to each dog.

    If you are new to Medina County or you have just obtained a new dog, please be sure to get your license 30 days from the date you acquired the dog.

    If your dog loses or destroys their tag, please stop by Auditor Capretta's office and we will make a new tag for you at a cost of $5.00 per duplicate tag.

    We also sell 3 year dog licenses at a cost of $42.00 and permanent dog licenses at a cost of $140.00.

    Kennel licenses are $70.00. If purchased late, they are $140.00.

    You may purchase a 1 year, 3 year or permanent license online, but they will be subject to a processing fee.

    Allows low-income senior citizens and permanently, totally disabled Ohioans to reduce their property tax bills by shielding some of the market value of their homes from taxation.

    Disabled Veterans Expanded Homestead Exemption

    Available for military veterans who have been determined to have a permanent, total service-connected disability (or surviving spouse of a person who applied for and qualified in the year of death).
    We are now working with the Veteran Service Office of Medina. You will need to complete the Application of Summary of Benefits Letter along with the Homestead DTE 105i forms. Both forms can be accepted at the Auditor's Office or the Veteran Service Office.

    Surviving Spouses of Public Service Officers Killed in the Line of Duty Homestead Exemption

    Available for the widow or widower of a peace officer, firefighter, or other emergency responder who dies in the line of duty or by an injury or illness sustained in the line of duty. This reduction allows $50,000 of the market value of the property to be exempted from taxes, which will show as a credit on property tax bills.

    Using a hypothetical example property, here are some items from the property tax bill:

    1. 100% Appraised Value = $100,000
    2. Effective tax rate = 56.896453
    3. Non-Business Credit Factor = .087869
    4. Owner Occupancy Credit Factor = .021967
    1. Determine the Taxable Value of the property (also shown on the tax bill)
      Formula: (100% Appraised Value) x 35% = Taxable Value
      Example: $100,000 x .35 = $35,000
    2. Calculate the Sub Total tax due
      NOTE: Your tax bill will show an extra step for Gross Real Estate tax and the Tax Reduction that is not necessary for the calculation. It is shown on the tax bill for information only.
      Formula: (Taxable Value) x (Effective Tax Rate) / 1,000 = Sub Total tax
      Example: $35,000 x 56.896453 / 1,000 = $1,991.38
    3. Calculate the Non-Business Credit
      Formula: (Sub Total) x (Non-Business Credit Factor) = Non-Business Credit
      Example: $1,991.38 x .087869 = $174.98
    4. If the property is “owner-occupied” there may be an additional Owner Occupancy Credit on the home and 1 acre.
      Formula: (Sub Total) x (Owner Occupancy Credit Factor) = Owner Occupancy Credit
      Example: $1,991.38 x .021967 = $43.74
    5. Reduce Sub Total by credits
      Formula:
      (Sub Total) – (Non-Business Credit) – (Owner Occupancy Credit) = Net Current Taxes
      Example:
      $1,991.38 - $174.98 - $43.74 = $1,772.66
    6. Full Year Due = $1,772.66
    7. Half Year Due = $886.33

       Important Consumer Information

    The Ohio Department of Agriculture is the custodian of the Ohio Primary of Weights and Measures, which are traceable to U.S. Standards of the National Institute of Standards and Technology (NIST) in Gaithersburg, Maryland. Local jurisdictions are responsible for testing and inspecting all commercial weighing and measuring devices such as scales, gas pumps, UPC scanners and more. The state assists in the testing and inspection of vehicle scales, livestock scales, fuel meters (fuel oil, gasoline and LP gas) and packaged consumer goods.


    Gas Pumps

    Credit card skimming continues to be a serious identity theft problem across the country. Avoid being scammed at gas stations by taking the following precautions:

    • Use a credit card, not a debit card to purchase your gas. You aren't usually liable for fraudulent charges on a credit card, but if scammers gain debit card information, they may be able to drain the entire attached bank account.
    • Use gas pumps that are within the line of sight of the station's clerk. Thieves are less likely to install skimmers on high profile pumps.
    • Inspect the pump before inserting a credit card. If there is tape near the card reader or any part of the device is loose, don't use it. If you suspect or spot indications of forced entry to the pump, avoid it. Alert station attendants.
    • Identity thieves have greater control over your stolen information if they also have your PIN or zip code. Always cover the pad while typing, even if no one appears to be nearby.
    • Always check credit card statements. Report unusual activity to credit card companies immediately.

    Scales

    Commercial scales are used to price items by weight. A deli scale is one of the more frequently checked scales of this type. Non-commercial scales are the scales that you see in doctors' offices or schools.

    • Watch the scale and the amount registered. The scale should be placed so you can see the weight, price and other information displayed.
    • Make sure the scale shows a zero or minus sign before anything is weighed. Pay only for the product, not for the packaging.
    • If you have any questions about how a store weighs or measures products, ask the manager for information first. He or she should be able to answer your questions.
    • If the problem is not resolved, contact your Medina County Weights and Measures Department for assistance.

    UPC Scanners

    Our Weights and Measures Inspectors randomly select items from a store, choosing items from all departments. They write down the item and the sticker price, then take the items to the register and scan each item, to ensure the sticker price and checkout price coincide. Stores are required to correct the pricing in their computer so that the item scans correctly.

    • Watch as the price of the item appears on the check-out register.
    • Ask the clerk to check the price if you think the scanned price is incorrect.
    • If the scanned price does not agree with the posted price, ask the store manager to correct it.
    • Save your purchase receipt, in case you have questions or a problem later on.
    • If the problem is not resolved, contact your Medina County Weights and Measures Department for assistance.

    Firewood

    Legally, firewood should only be sold by the cord or by fractions of a cord. A cord is 128 cubic feet, which is the height multiplied by the the length, multiplied by the width.

    It is important to know that terms such as truckload, face cord, rack, and pile have no legally-defined meaning and therefore a buyer has no way of determining how much firewood they are actually receiving. Make sure you have a telephone number and sales receipt for your wood. Stack your wood when you receive it and determine if it is a cord. If not, and if the seller will not correct the problem, contact the Weights and Measures Department for assistance.


    Gas Cans

    We often receive calls from residents who paid for more than two gallons worth of gas and wonder if they were cheated. Usually the gas can is to blame, since they are generally inaccurate in measurement. Gas cans are approximates. If you have a two-gallon can, it may actually take a little more or a little less to fill the can up.
